Find a Solicitor for your

Patent

Hassle-free help from the UK's best commercial solicitors.

Great Interaction
Great interaction. I had a simple question which would have cost a fortune going to see a local solicitor. It was all very professional but still friendly. The solicitor I spoke to was the chief executive of her law firm (I looked her up on LinkedIn). You are dealing with very good lawyers who earn additional money through Lawhive. I would definitely use this service again. Highly recommend.

The solicitor who was appointed to me was outstanding
Very simple to engage with instant confirmation in writing straight after. Daniel, the solicitor who was appointed to me, was outstanding in his approach, his understanding of the technicalities of the law and, crucially, a genuine care for the client. Would definitely advise using Lawhive, you won't regret it.

We were so pleased to find the Lawhive website
After struggling to find a solicitor willing to give us advice, and for a reasonable cost, we were so pleased to find the Lawhive website. At first we wondered how well it would work, but needn't have worried at all - the whole process was simple, straightforward and professional and great value for money. We felt extremely lucky to be matched with our solicitor, Sonay Erten, as she was exactly what we were looking for - knowledgeable, patient and kind - a refreshing change from solicitors we have used in the past. She showed a great deal of empathy for our situation and explained things in language that was easy to understand (rather than the usual "solicitor" talk, which can be intimidating). She's a shining example of what a solicitor should aspire to be and I wouldn't hesitate to recommend her to others or use her again in the future. We came out of our session reassured and confident of what we needed to do going forward, so a big "thank you!"

Fast and professional
I got the outcome I wanted regarding cease and desist to a competitor spreading defamatory statements about my business. Fast and professional, and at a much lower price than high street firms. Highly recommended thanks.

Very efficient! Can highly recommend.
I found the website very easy to use. Quick responses and I was even able to talk to someone who was friendly and competent. She rang me rather than emailed me. A solicitor was quickly found who could help me and once the relevant identification was approved he started work. Within two days the solicitor had checked documents and commented on them. Very efficient! Can highly recommend.

What is a patent?

A patent is a legal document that grants the owner exclusive rights to their invention and stops others from making, using, or selling it without permission for a specific amount of time.

What can be patented?

You can patent inventions that are new, inventive, and applicable, such as products, processes, methods, or software with a technical purpose.

You can't patent things like artistic works, ways of doing business, medical treatments, or software with a non-technical purpose.

If you're unsure whether or not your invention can be patented, a commercial solicitor can provide personalised advice.

How long does a patent last?

A patent lasts 5 years. After that, you have to renew it every year, up to a maximum of 20 years.

Should I apply for a patent?

A patent protects your invention, giving you control over its use and commercialisation. It can also enhance your credibility and attract investors or potential buyers.

But you should only apply if you're confident your invention doesn't already exist and you can commit both the time and money to the application process.

How do I apply for a patent?

The patent application process involves:

  1. Preparing detailed documents describing your invention including technical features to be protected and a summary of important technical aspects.

  2. Filing these documents with the Intellectual Property Office and paying the fee.

  3. Asking the IPO to check if your invention is new and inventive.

After you submit your application to the Intellectual Property Office (IPO), they'll conduct a basic check and then perform a search to confirm if your invention is new and inventive.

Your application will be published, and a substantive examination will be carried out.

When your patent is granted, you'll receive a certificate. However, sometimes the IPO may suggest you make certain changes before granting your patent.

How much does it cost to apply for a patent?

The minimum cost to apply for a patent is £310, which covers:

  • Filing your application

  • Carrying out searches within 12 months of filing your application

  • A substantive examination.

There may be additional costs if, for example, you pay for filing your application or the paperwork you submit goes over a certain amount.

The cost for a specialist patent lawyer to help with your application depends on many factors including the complexity and specific requirements of the case. On average it is expected to range from £375-£500 but in some cases, it could cost as much as £573.

What does a patent lawyer do?

A patent lawyer specialises in intellectual property law and helps clients obtain patents for their inventions.

They provide legal advice, conduct patent searches, draft patent applications, and represent clients in patent disputes if rights have been infringed upon or in cases where there's a dispute over patent ownership.

When should I hire a patent lawyer?

It's advisable to consult a patent lawyer early in the invention process to assess patentability, conduct prior searches, and strategise for patent protection.

How do I choose the right patent lawyer?

When selecting a patent lawyer, consider their experience, technical expertise, track record of success, and communication style.

It's essential to find someone who understands your invention and can effectively advocate for your interests.

How much does it cost to hire a patent lawyer?

The cost of hiring a patent lawyer varies depending on factors such as the complexity of the invention, the scope of legal services required, and the lawyer's billing structure. Many patent lawyers offer initial consultations or fixed-fee arrangements for patent applications.

The cost for a licensed solicitor to help with a patent can range from £375-£500 but in some cases, it could cost as much as £573.

Can a patent lawyer help me with infringement issues?

Our network of solicitors has a lot of experience defending and prosecuting patent infringement claims.

Patent lawyers can help you enforce your rights if another company copies your IP, or defend against another company claiming you have infringed their patent.

As a patent holder, it is important to keep your eyes open to new product launches in your sector, to determine if any infringers have attempted to copy your IP.

You can only take legal action against another party when you have been granted a patent, if your patent is being filed you will have to wait until it is granted to sue for damages.

How can a patent lawyer help protect my intellectual property rights?

A patent lawyer can help clients develop a patent strategy. The purpose of this is to protect a company’s interests. This should be tailored to the needs and objectives of each individual or company.

A patent strategy will outline the specifics of how a patent operates.
